Prime HVAC Texas Services Agreement

Introduction
These Terms and Conditions ("Terms") govern your use of Prime HVAC Texas services and website. By engaging our services or using our website, you agree to be bound by these Terms. Prime HVAC Texas reserves the right to modify these Terms at any time. Your continued use of our services constitutes acceptance of any changes.
Service Terms
Service Scope
Prime HVAC Texas provides heating, ventilation, air conditioning, and indoor air quality services throughout Texas. Services include installation, repair, maintenance, and emergency services for residential and commercial properties.
Scheduling and Availability
Regular service appointments are scheduled during normal business hours. Emergency services are available 24/7 with additional charges. Appointment times are estimates and may vary due to weather, traffic, or unforeseen circumstances.
Property Access
Customer must provide safe and reasonable access to HVAC equipment and work areas. Prime HVAC Texas is not responsible for damage to landscaping, decorative items, or personal property unless caused by gross negligence.
Payment Terms
Payment Due
Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, checks, and major credit cards. A service charge may apply for returned checks.
Estimates and Pricing
Written estimates are valid for 30 days. Final pricing may vary if additional work is required beyond the original scope. Emergency service calls may incur additional charges for after-hours, weekend, or holiday service.
Late Payment
Accounts not paid within 30 days may be subject to a 1.5% monthly service charge. Prime HVAC Texas reserves the right to suspend services for accounts in arrears.
Warranties and Guarantees
Workmanship Warranty
Prime HVAC Texas warrants all labor and workmanship for one (1) year from the date of completion. This warranty covers defects in installation or repair work performed by our technicians.
Equipment Warranty
New equipment is covered by manufacturer warranties. Prime HVAC Texas will assist with warranty claims but is not responsible for manufacturer defects or warranty coverage decisions.
Warranty Limitations
Warranties do not cover normal wear and tear, damage from neglect, misuse, or failure to perform recommended maintenance. Customer modifications or repairs by unauthorized persons void all warranties.
Liability and Insurance
Insurance Coverage
Prime HVAC Texas maintains general liability insurance and workers' compensation coverage. Proof of insurance is available upon request.
Limitation of Liability
Prime HVAC Texas's liability is limited to the cost of services performed. We are not liable for indirect, consequential, or punitive damages. Total liability shall not exceed the amount paid for services.
Customer Responsibility
Customer is responsible for providing accurate information about their HVAC system and property conditions. Failure to disclose known issues may void warranties and increase liability.
Emergency Services
Emergency Response
Emergency services are available 24/7 for urgent situations such as complete system failures, gas leaks, or safety concerns. Emergency service rates apply for calls outside normal business hours.
Emergency Charges
Emergency service calls incur additional charges for after-hours response, weekends, and holidays. These charges are in addition to standard service and repair costs.
Safety Priority
In emergency situations involving gas leaks or carbon monoxide, immediately contact emergency services (911) before calling Prime HVAC Texas. Safety is our primary concern.
Maintenance Agreements
Service Plans
Maintenance agreements include scheduled inspections, cleaning, and tune-ups. Plans are renewable annually and may be cancelled with 30-day written notice.
Plan Benefits
Maintenance plan customers receive priority scheduling, discounted service rates, and extended warranty coverage on covered systems.
Plan Limitations
Maintenance plans cover routine service only. Repairs, parts, and emergency services may incur additional charges even for plan members.
Website Use and Privacy

Content on the Prime HVAC Texas website is for informational purposes only. We reserve the right to modify content without notice. Users may not reproduce or distribute content without permission.
Privacy Protection
Customer information is protected according to our Privacy Policy. We do not share personal information with third parties except as necessary to provide services or as required by law.
Communication Consent
By providing contact information, customers consent to communication via phone, email, or text message for service-related purposes and appointment reminders.
Dispute Resolution
Resolution Process
Customer concerns should first be addressed directly with Prime HVAC Texas management. We are committed to resolving disputes fairly and promptly.
Arbitration
Any disputes that cannot be resolved through direct communication may be subject to binding arbitration in accordance with Texas law.
Governing Law
These Terms are governed by Texas state law. Any legal proceedings shall be conducted in Texas courts with proper jurisdiction.
Miscellaneous
Severability
If any provision of these Terms is deemed invalid, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between Prime HVAC Texas and the customer, superseding all prior agreements and understandings.
Force Majeure
Prime HVAC Texas is not liable for delays or failures due to circumstances beyond our control, including natural disasters, severe weather, or government actions.
